Terms and Conditions - SAS Australia and NZ

Custom Training and Education Events (the "Agreement")

Important: Please carefully read the following terms and conditions. By accepting training from SAS, you agree to these terms. If you do not agree to all of the terms of this Agreement, please contact your local Education Administrator.

In exchange for payment of the fees and any applicable taxes arising under this Agreement and the relevant event confirmation letter as described below, SAS Software Limited ("SAS") will provide training and/or education events (the "Event(s)") to the Customer as specified in the event confirmation letter, subject to the following terms:

  1. Group Training Contract Once SAS has received, by return, the signed group training proposal, the Event is deemed confirmed.
  2. Payment Terms
    Full payment for each Event is due on terms of net thirty (30) days from commencement of the Event.
  3. Event Prices
    1. For Events held at SAS premises or third party site (eg. an external training centre like Cliftons), the price includes all printed materials, lunch and refreshments.
    2. For Events held at a Customer site, the course price will include all printed materials. 
  4. Cancellation and Transfer Policy
    1. Should an Event require cancellation, then please contact your Education Account Manager.
    2. If a cancellation is made more than ten (10) working days prior to the Event commencement date then any monies that have been received by SAS for the Event will be returned to the delegate party in full.
    3. If the cancellation of the Event is made less than ten (10) working days before the Event commencement date then a cancellation fee equal to the full Event price will be due.
    4. If the Event can be transferred to another date that is agreed by SAS and the Customer, no cancellation fee is payable provided the rescheduled Event takes place. In such case, there will be an administrative charge of 25% of the Event price.
    5. An Event may only be rescheduled once. If the rescheduled Event is cancelled a cancellation fee of the full Event price will be due.
  5. Event Setup
    The Customer will provide all the necessary equipment as discussed with the Education Account Manager when booking the Event. For courses, it is essential that current licensed software required for the Event is installed on each training room PC. Separate agreements are required to provide for short term licensing of any required software.
  6. Delegate Details
    1. Any reduction in delegates within ten (10) working days prior to the Event commencement date will not be reflected in a price reduction.
    2. Any increase in delegate numbers will result in an increase to the Event price.
    3. Delegate names must be supplied to the Custom Event Manager at least three (3) working days prior to the Event commencement date. SAS will make no charge if a substitute delegate replaces the original delegate. Please contact your Education Account Manager to confirm any delegate changes.
  7. Event Timings
    One course day is deemed to be approximately seven and a half (7.5) hours including one hour for lunch and half an hour for breaks.

  8. Changes to Content
    SAS' courses are constantly being reviewed, updated and improved and SAS reserves the right to alter any of the course content without prior notice. It may not be possible to cover all course topics due to unforeseen circumstances. The Instructor will advise delegates when this is the case and may offer alternatives.
  9. Event Applications
    SAS reserves the right to decline applications for Events without prior notification.
  10. Cancellation of Events by SAS
    SAS reserves the right to cancel or reschedule an Event at any time without liability. In these circumstances, the Customer will be offered an alternative date or a full refund of any paid Event fee.
  11. Confidentiality
    The Customer will implement reasonable measures to prevent SAS' inadvertent access to confidential information. SAS agrees to use reasonable endeavours to prevent any confidential information received in connection with and related to the Event(s), which is clearly marked or designated at the time of disclosure as "Confidential", from being revealed to third parties for a period of three (3) years from the date of disclosure. This restriction does not apply to information which is: (1) generally available to the public; (2) released by the Customer without restriction; (3) independently developed or acquired by SAS; (4) known to SAS prior to receipt from the Customer; or (5) revealed pursuant to court order or process of law. SAS will use reasonable endeavours to give the Customer notice of such order prior to disclosure. For the purposes of this clause, SAS' parent company, SAS Institute Inc., shall not be deemed a "third party." SAS' privacy statement can be found at www.sas.com/privacy.html
  12. Copyright
    1. The Event material is the exclusive copyrighted property of SAS. None of the Event material may be reproduced, republished, distributed, posted, sold, or transferred. SAS' Copyright extends to all electronic or supplementary materials provided as part of an Event.
    2. Course notes are available only for course attendees and are provided on the first day of a course. Course notes are not available prior to the course.
